Streep was driving the car and Howe was slumped in the passenger's seat. The officers became suspicious because of the late hour, the cautious manner in which Streep was walking after exiting the car, and the fact that Howe appeared to be hiding. The police, who followed the car and determined that it was stolen, turned on their flashing lights and siren. Streep refused to stop, driving away at speeds in excess of 100 mph. Streep lost control and crashed in a field. One officer apprehended Howe who had gotten out of the car immediately after the accident and appeared ready to run.Earlier in the day, Howe was watching television at a friend's home when Streep, the friend's boyfriend, joined them. Howe testified that this was the first time he met Streep. Eventually, Streep left for several hours and then returned and invited Howe to ride in the car.
