a community chest may qualify as a charitable organization by satisfying all of the following requirements, except:

a. it is organized or created in (or under the laws of ) the united states, any state, the district of columbia, or a u.s. possession

b. it is not subject to disqualification from tax-exempt status due to its attempting to influence legislation

c. it must operate exclusively for one of the enumerated purposes listed in the internal revenue code

d. no more than 5% of its net earnings can inure to benefit of any private shareholder or individual
