(a) Eunice Nyamu has come to your famous firm of advocates. She alleges that the County Government of Nairobi is taking steps which are prejudicial to her rights without her being heard in some matters regarding her business. Her case is that she is amedical practitioner and proprietor of LAK medical and dental clinic based in Nairobi County. That her aforesaid clinic is fully licensed to operate as such by the Medical Practitioners and Dentists Board and has a regulatory body wherein she pays an annual fee to practice, and she has paid. That as such, the County Government of Nairobi does not have any mandate over the same and cannot regulate professional businesses such as hers and demand payment for business permit fees as she makes practice fee payments to a professional body. That some times on 11^thMay 2024 the County Government of Nairobi employees entered her premises and demanded payment of the business permit fees, issued her with bonds to appear in court on 30^thMay 2024 and further carted away her stethoscope and auroscope kit. That there was no formal demand for the fees or reason as to why she was being subjected to pay the fees as she operated as a professional. Further, there was never service of a prior written notice to demand payment of the business permit fees and that as a professional, she pays license fees to the regulatory board which operates as a practice permit and requiring the business permit from her would amount to double taxation and which act is arbitrary and not justiciable. Moreover, she is of the view that the County Government of Nairobi does not have the powers to take such kind of action.
