A female softball coach at Smithfield High in Brockport, Indiana, Jane Russell, had concerns over a change in policy of a neighboring district, which was going to allow transgender females to compete on female athletic teams. The coach was considering forfeiting a scheduled game against the neighboring high school because she felt that the other team would have an unfair competitive advantage. Before making a final decision, the coach decided to send out an unsolicited email to the players and their parents explaining her views in opposition to transgender females participating on female sports teams and asking for their feedback and support. The emails were sent during fourth period from the coach's work email and contained a couple of links to reports of females being injured by transgender female athletes in athletic contests. One of the parents, whose sister is transgender, found the email to be objectionable, so she published it on X with hashtags #smithfieldhighschool and #transphobia along with a comment that the coach was overstepping her authority. The posting goes viral, and the school is inundated with emails and calls demanding that the coach be terminated for sexual discrimination. A local news station decides to run a story on the controversy and, in an interview, another teacher at the school states that the controversy has sparked considerable debate and disharmony among some of the staff. The district already had some concerns over the teaching practice of Coach Russell after receiving a couple of complaints about the coach's pedagogical practices which consisted mostly of showing videos and distributing worksheets coupled with weekly current events discussions. The scores of students in the coaches' courses on state assessment measures have consistently been below the campus and district averages and the coach has been less than enthusiastic about attending and implementing instructional practices in the classroom. As a part of their investigation, school officials collected a district-owned laptop that was assigned to Coach Russell to confirm if she had been using the laptop for personal business and communication during class time. The search revealed two password-protected folders that included articles related to Title IX and female athletics and one that had information about a select softball team that the coach was running as a side hustle to make money. The search also showed that Coach Russell was on the computer conducting personal business numerous times through most school days while she was supposed to be teaching. When contract renewals come around, the coach is transferred to an elementary school and assigned to serve as a PE teacher with the same base pay as her previous contract. If the teacher files a complaint claiming that her transfer was in retaliation for the exercise of her expression rights, does she have a case?
