A few weeks ago we discussed the tort of misappropriation of the right to publicity. Ellen DeGeneres and Sandra Bullock are suing because a company (or companies) have used their likeness to promote various products. The company does this without paying them a dime. I have seen these adds on my social media feed. I really had no idea it was not legitimate. So many celebrities endorse a product.

So, can we as the public determine what is a "fake" advertisement? Also, discuss what makes it difficult for celebrities to sue these companies? Talk about the logistics and is it worth it if you are a celebrity to sue (time and money)? Is there a better way to control this flow of advertising that altered or simply fake? What about products that look like a designer, but are really a fake? What are the implications for companies who have their designs stolen? Have you ever bought a fake purse, jeans, sunglasses??
