A house and lot registered in the name of Dominador was occupied by his siblings

Emeterio and Narcisa. Dominador died without issue, leaving his wife Graciana.

Arnelito claims that he is an acknowledged illegitimate child of Dominador and that

Emeterio and Narcisa occupied the house and lot only after they pleaded him to occupy

the same and on the condition that they would vacate should Arnelito need to use the

property. Emeterio and Narcisa, however claims that Arnelito's right to succeed is doubtful

because Dominador was survived by his wife, Graciana. Arnelito filed an ejectment case

in his own name and as the sole owner of the property against Emeterio and Narcisa.

The nephews and nieces as heirs of Graciana questioned the authority of Arnelito

in filing the ejectment case contending that they are co-owners of the property and that

Arnelito cannot eject Emeterio and Narcisa from the property in his own name and as the

sole owner of the property. Arnelito, on the other hand, claims that even if there are co-

owners of the property, he may still file on his own an ejectment case. If you were the
