Deborah's former employer is FMA Designs - an interior design company - and Deborah was employed as a Senior Interior Designer. She worked at FMA Designs for approximately 8 years before she was terminated. She was paid $80,000/yr.

The scenario is as follows:

In March 2022 Deborah found out that she was pregnant with her first child. Thrilled with the news she began telling her friends, family and coworkers. She also requested a meeting with her boss, the owner of FMA Designs, to inform him of the news. This meeting was held on April 4, 2022. During this meeting Deborah informed her boss that she was pregnant and due in December 2022. She assured her boss, Ricardo Manli, that her work would not be affected and that she intended to return to work immediately following her maternity leave.

Deborah was an excellent employee, was never disciplined in any way, got along with her coworkers and never missed a day of work.

Shortly after this meeting Deborah began hearing rumours from her coworkers that Ricardo was worried about Deborah missing work during her pregnancy and that he really didn't want a pregnant woman around the office. Thinking these were only rumours Deborah didn't think anything of it.

On April 10, 2022 Deborah was called in to Ricardo's office for an urgent meeting. When she arrived at Ricardo's office a member of the Human Resourses department of FMA Designs was also present. During this meeting Deborah was informed that she was being terminated as Ricardo believed she was spreading rumours amongst her coworkers that FMA Designs was a terrible workplace and mistreated their employees. Deborah tried to defend herself as these allegations were completely false but Ricardo refused to listen to her. The HR representative proceeded to give Deborah a letter of termination indicating she was being terminated with cause and thus would not be given any notice or pay in lieu of notice. Deborah was then escorted to her desk by security to gather her belongings and then escorted out of the building.

A few days later a coworker of Deborah's sent her a text message saying she overheard Ricardo and the HR representative talking in his office after Deborah was escorted out saying that they were happy they wouldn't have to deal with a maternity leave for Deborah now that she was terminated.

Deborah strongly believes she was terminated for being pregnant. It has been three months and Deborah has not been able to find new employment. She has applied to over 20 jobs band has been two 10 interviews but has not been successful. She is currently not making any money and is worried about her financial status when her child is born.

She has now retained you to file a Form 1: Application to the Human Rights Tribunal on her behalf.
