Question:
A marketing brochure for a skin softner for hot tubs and spas stated that 3 oz would soften the water for up to 3 days and prevent your skin from drying out. Iris purchased a bottle based on the claim and started adding it to the water every 3 days as instructed. She ound her skin was still drying out and itchy after use. So she tried another product that stated:'incredible breakthrough for skin softening for spas - use one ounce and it is good for a week of regualr use.' They also claimed it was safe to use in all spas andd with other spas oils,. She initially found no effect and then broke out in a itchy rash. There was no mention of any of this on the bottle,so she contacted the manufacturer. They told her she must have combined the product with something else to ge this reaction as it has never happened before. She went to her doctor and was told she had an severe allergic reaction and she had told him about the use of product. The rash persisted and she took the medicine prescribed. She continued to go to allergists trying to improve the rash, but treatments were getting too expensive to continue.
She has sought legal advice to compensate her for all the expense, time and suffering from the product. Did either of these manufacturers commit a mistake or misrepresentation in theri labelling and commnication( types & remedy)
