(10 marks) George agreed to perform at a concert organized by Charles, for which George was to be b) paid RM8, 000. One of the terms in the written agreement between them was as follows: "If George fails to perform at the concert, he will pay Charles RM50,000 as agreed damages for Charles' loss." George did not perform at the concert because he was offered a sum of RM15,000 to perform at another place at the same time. Charles is now claiming from George the sum of RM50,000 as damages in accordance with the terms of the contract. Advice George whether he is bound to pay the sum of RM50,000 or any other sum to Charles. (10 marks) c) Jim promised his nephew Aaron that if Aaron scores 5 As for his examination, Jim will give Aaron RM10,000. Aaron scored 5 As. Aaron asked his uncle for the RM10,000 but Jim gave him RM1,000 only. Aaron is very upset as he worked very hard for the exam and was looking forward to using the RM10,000 to pay for his college enrolment.
