A private swimming club has an exclusion clause saying: " The Club Management is not responsible for any guest's loss of belongings from the pool and its surroundings. " Jane is a guest of the Club. She loses her mobile phone when the lock on her locker in the changing room is broken into. She paid $200 to hire the locker and was assured of the safety of her belongings in the locker by the Club front desk manager just before Jane signed a form at the Club front desk. The form had a list of clauses with heading " Club's Terms and Conditions " printed on it. The Club's exclusion clause is listed as one of them. There was also a notice of the same Club's terms and conditions displayed at the back of the changing room and the exclusion clause was also printed on the receipt for the locker which Jane received by mail two weeks after she paid the $200.
