A Swiss NPO called SNA which manufactures and sells ski equipment gives faulty skiing equipment to a skier Anne who hails form Finland and who then suffers an injury and cannot walk without assistance. As per the EU Directive 2017-2022(which is a fictitious directive for this case only) or the Winter Sports Directive, as it is also called, SNA must recompense Anne. But while transposing this directive to Finnish law, specifically the National Consumer Act 2016 (also fictitious and invented for this case only), no compensation is due.
The QUESTION: Please advise Anne as to remedies available to her under EU law to initiate legal action against SNA. Can she ask for compensation under EU directive which contrasts with national law that does not allow for compensation?
