A tax prepares may be assessed a prepared penalty for a tax return or claim for refund that understates the taxpayers liability due to an unreasonable position that the preparer:

a willfully and recklessly pursued

B avocated without reguard for due diligence

c knew or reasonally should have known

d accepted beyond reasonable doubt
