(a) Tony and Harriet saw an opportunity to make some money for their local surf club by selling cold drinks and ice cream to people on their beach from a small refrigerated four-wheel drive van. They used their own money and a loan Tony obtained from the local bank to buy the necessary equipment and get the necessary council permission and permits. They planned to recoup their outlay from initial profits and then pay the balance into the surf club trust account. However, the business venture did not go as planned owing to a particularly cool, wet summer. While some sales were achieved and prospects looked good, Tony was unable to repay the loan when it fell due because sales were poorer than anticipated. Explain whether Harriet is liable for the debt in this type of business structure.

(b) Tony and Harriet have come up with their own ice cream with unique flavours. They want to protect their creations. Advise them as whether there is any legal protection for such creations and the criteria to be satisfied for such intellectual property protection.

(c)  Angus is hired by Harriet to sell ice cream occasionally when Harriet is not able to take care of sales. One day, he gets stuck in the small cooler room in the van for half an hour because of a faulty door. He suffers pneumonia as a result. Harriet had known about the faulty door but failed to get it repaired or mention it to Angus. Advise Harriet whether she is responsible for Angus under Employment Law.
