A well-known restaurant in town has advertised an offer of a special dinner for the last week of January next year at a price of $100 for a couple. The menu for this special dinner can be obtained at the restaurant at any time during the month of November only. All bookings for the special dinner in January 2022 must be done in the month of November 2021. Joseph and his wife read about the advertisement and are interested to make a booking for the special dinner on the 31st January 2022.
They take the trouble to drive to the restaurant to get the menu. After having read the menu, they want to place a booking. They approach the clerk at the counter. Mrs Joseph suggests and asks for a dessert to be included. The clerk, however, is not in the position to do so but takes down the address and telephone number of Joseph. A few days later, Mrs Joseph calls the restaurant but the reservation clerk has been away from her desk and another person answers the call and tells her to call back later. Mrs Joseph has forgotten to call back the restaurant. Come 31, January 2022, Mr and Mrs Joseph arrive at the restaurant to have the special dinner and they discover that no table has been reserved for them. They are disappointed and embarrassed. However, the restaurant manager has been sympathetic with their situation, offers them a table but with a different menu at the same
price. Joseph does not want to accept the manager's offer and leaves the restaurant. Joseph intends to sue the management of the restaurant.
