ABC Construction was hired to remodel a mid-town Manhattan business building on Madison Avenue. The projected time it would take for the remodel was that the area would have limited access.Some of the businesses in the immediate area were not happy because it meant that their businesses would be suffer during that time.

During the remodel, awall partially collapsed from a 39-story office tower. All the bricks and mortar fell on Madison Avenue causing the closure of 15 blocks for two weeks and some businesses remained closed for longer (5 weeks). The collapse was caused by a construction project drilling 94 holes for windows in the building that aggravated existing structural defects. Several of the businesses then sued for economic loss for not being able to stay open and losing business.
