ACBUS202A Commercial Law II - Assessment Event 1 - Portfolio

As detailed in the Subject Guide, portfolio activities are due in class each week from weeks 2-11. Student portfolio activities are marked each week as follows:

• 0 marks - the student did not attempt the activity.
• 1-1.5 marks - the student attempted the activity, with a superficial or incomplete
• response.
• Up to 2.5 marks - the student made a genuine attempt, addressing all activity
• requirements.

• Vivi inspects a property that she has been renting out. The house is surrounded by a lush garden, a swimming pool, a garden shed and a brick barbecue. The tenant tells Vivi that he owns the swimming pool which sits on the surface of the land, he is also planning to dismantle the brick barbecue which has been cemented in the ground and he also wants to take the tin shed that sits on the grass. Vivi is not impressed with the removal of the items; she had agreed to the installation of each and their removal will leave significant 'gaps' on the lawn and the sites where these facilities were located.
• Question: Vivi wants to know what her rights are regarding the removing of what look like permanent objects on her land by the tenant.
