Acson Sdn. Bhd. is a semiconductor's producer that has been operated for 10 years in Tanjung Malim, Perak. Acson Sdn. Bhd. has employed 500 employees and has expanded its business by opening two branches in Johor and Penang. Due to that matter, Acson Sdn. Bhd. needs to transfer some of its current employees to the new branches effective 1st January 2021. The management had given 3 months' notice of transfer to the selected employees. However, some of the employees had shown negative responses on the transfer exercise. Those unsatisfied employees intended to form a union in order to represent them. They believed a proper Collective Agreement between union and the employer could save them from the transfer exercise. On 1st May 2020, the employees had registered their union as Kesatuan Pekerja-Pekerja Acson Sdn. Bhd (KPASD). The union has been legally registered with 100 members by the Director General of Trade Union. Right after the registration, Mr. David, the President of KPASD and his union officers had drafted a proposal to invite the employer to commence the first Collective Bargaining meeting. The main agenda of this Collective Bargaining is regarding the transfer matter. Unfortunately, the employer had ignored and did not respond to that invitation. . Based on the case, answer the following: c) Explain the right of the employer to refuse to commence collective bargaining. (10 marks)
