The example you describe may or may not actually be negligence once you apply the facts to each elementyou should be able to explain this.

* Every semester, some students think they have (or someone they know has) never experienced a potential negligence situation. Most of us have experienced potential negligence at some point, but we consciously or subconsciously choose not to sue over it. If you are struggling to come up with an example, you are likely over-thinking what negligence is. Search online for examples of negligence just to get you brainstorming for the right kind of thing.

a. Summarize the events that occurred (describe the facts). 2 points

b. Identify the plaintiff (victim) and defendant (person or business entity the victim would sue) 2 points

c. List each element of negligence, as outlined in the PowerPoint slides for Chapter 7. 4 points
