Adam Manchester wanted to have an area paved in his yard large enough to park two cars. After reviewing bids from a variety of Contractors, he settled on Carlos Ruiz and on October 1 entered into an oral agreement with him to construct a paved area and paint it silver and black, the colors of his favorite football team, with the actual logo design of the helmet painted in the center of the paved area. In return, Manchester promised to pay Ruiz $6,000. Shortly before Ruiz was to begin work, he discovered that he could not make a profit unless Manchester paid him $8,000 for the job. Manchester (who thought he was getting a great deal even at that price) agreed. They entered into the following written agreement:
