: Based on my readings of the textbook, South Dakota's best defense against this lawsuit is that the party suing does not have the standing to sue. According to the text, "Standing means that the party that filed the action in court has a legally protected interest at stake in the litigation. At times, a person can have standing to sue on behalf of another person, such as a minor (child) or amentally incompetent person." While it is discriminatory that a redheaded person cannot enter the court, the parents do not have a sufficient stake in the matter when suing for their adult child, Alpha.

2) What would you recommend to Alpha's family to make the lawsuit stronger?

: To make Alpha's family's suit stronger, I would first recommend that Alpha file the lawsuit themself so it has a stronger standing. When the person being affected by the law seeks justice through the court system, they can better express the ways in which the law has harmed them, the causation, and show that it will be likely that a favorable court decision will remedy their injury. I would also recommend Alpha cite more specific ways in which the law discriminates against them and prohibits their rights. For example, they could cite that the law violates substantive due process by limiting Alpha's ability to seek their fundamental rights like marriage in a court house.
