Tracy Miller was a female sales representative who had been employed by a manufacturing company's Madison, Wisconsin, office for ten years. Her male supervisor, Scott Jenkins, regarded her highly. When an opportunity arose for Miller's promotion to \"Key Account Manager\" in Chicago which would have represented a signicant promotion for Millershe reasserted her long held desire to become a Key Account Manager to Jenkins. Instead, Jenkins gave the job to a young man. Miller led a claim for sex discrimination. Among other things, Miller asserted Jenkins had a history of making remarks to Miller, such as, \"You're being a blonde again today,\" or \"It's a blonde thing.\" Miller found the remarks personally offensive (and told Jenkins so several times); Jenkins claimed his \"blonde\" remarks were merely good-natured teasing, and he genuinely believed Miller's objections were in jest and not intended seriously. He also pointed out that being blonde is not a female characteristic, but a hair color. Jenkins testified that he decided against offering Miller the Chicago position not because she was a woman, but because she had children, and he assumed she would not wish to relocate her family.
