After making all that money this semester, Harry goes on a business trip trying to sell his dressers to Missouri. While there, he sees a Cardinals/Dodger game, but gets in a fight in the stadium. He punches a Cardinal fan who said "Dodgers suck". He then gets in his car, and while upset, does not notice and runs through a red light and strikes a pedestrian who is not in a crosswalk. He says he was driving safely. He is sued for "negligence" by the driver of the car, and served at his house in Costa Mesa, California and summoned to appear in the St. Louis, Missouri court. He reads the Nicastro case and decides to ignore the summons.

  1. Since he lives in California, should he worry about being sued in Missouri? Use the FIRAC method, and tell me how the US Supreme Court would rule if a Missouri court says they have jurisdiction over Harry. In your answer to question 1, do NOT discuss negligence.

2. Tell me how you would prove that Harry committed negligence when he struck the pedestrian with his car. Please note the elements of negligence in your analysis. Then, tell me if negligence per se applies.
