I think it would have been fair if he wasn't able to recall some information but in this case he basically didn't have much answers at all. As Mr. Nelson stated in his declaration that he basically didn't have much recollection about the operational procedures. activities etc. at all for someone who has been managing the IT department. The emails in the exhibit 4 makes it very clear what his intentions along with J. Rudd and others were. These emails are the proof that they all conspired to push Level Propane to bankruptcy to which John Verbose' 5 cut was 20%. John Verbose created the email account for his partners in crime so they could monitor all the checks and gave them the reports. Other reasons for the account he created included reviewing the company's account to show where the company has lost money. having guest 6 (Pam) show that the company is losing sales and customers. In his email he is clearly aware about Benesch, Friedlander and Associates company but as seen on page 4 of Verbose Depo Part 1 "Okay. And Level at that time was represented by whom? A.
