Ah Chong bought a house in 2001 by taking a housing loan from Bank ABC. He pays RM800 a month to Bank ABC and has never failed or delayed his payment. The housing loan is for a duration of 25 years. In view of Covid - 19, Bank ABC decided that Ah Chong need not repay his loan for the month of March, April and May 2020. Ah Chong whose business is severely affected by Covid - 19 is very grateful of Bank ABC's decision. Hence, he did not repay his housing loan for the three months. He was required to sign a document with Bank ABC to that effect. Additionally, Ah Chong was required to pay RM400 in order to be entitled to the deferment payment plan. Ah Chong enquired whether the RM400 will serve as a 50% payment for the housing loan of one of the months. Bank ABC replied that it was not. Fearing that he will lose out on the entitlement of the deferment payment plan, Ah Chong paid the RM400. However, as the Movement Control Order (MCO) was lifted on 9th June, Bank ABC has now written to Ah Chong requiring him to immediately pay the housing loan for the month of March, April and May 2020. In fact, the document which Ah Chong had signed contained a clause that "in the event MCO is lifted, all unpaid amount will be immediately repayable". As Ah Chong is illiterate, he did not understand the contents of the document. Ah Chong now seeks your advice.Advise Ah Chong.
