5.Mahmud does not maintain any account nor does he have any business in Good Bank Bhd. One day, Mahmud arrived at the bank, and as he stepped inside, he slipped and fell as the floor at the bank’s entrance was very wet. If Mahmud decides to take legal action, will the legal action be based on a contract or tort? Give reasons for your answer.

The Yayasan Pendidikan Negara already offered a scholarship for her study. Under the scholarship agreement, she is bound to give her service with the Yayasan for a period of seven years after her graduation. In another situation, she also entered into an insurance policy to protect her life and health when she studies abroad. The premium for the insurance is RM 100 per month. Advise Eisya on the issue of whether or not the above agreements are binding on her.
3.     Mr Kung applied for a credit facility from Bank XYZ Bhd for the financing of his new invention of a household utensil. Due to the uncertainties of Mr Kung’s product and other credit considerations, Bank XYZ Bhd declines to grant the facility, except at a rate of interest that is much higher than the market rate. Mr Kung accepts the facility on these terms. If Mr. Kung defaults in repayment, can he allege that the Bank XYZ Bhd had forced or pressured him to accept the facility at such a high interest rate and therefore the contract is voidable at his option?

John was angry and refused to take delivery of the vehicle. Jenny was shown a black Sapphire sedan car. She took delivery of the car. Two weeks later, the car engine exploded while she was driving. Advise John and Jenny.

6.    Rocky Star Events Sdn. Bhd. is a reputable event management company that has been operating for the last 15 years. They hire Iwan, a 25 years old talented singer in the entertainment industry to perform during the company’s annual event in April 2020 to appreciate their staff. Iwan accepted the invitation and his manager charged RM 20,000.00 for her professional fee and an advance of RM 10,000.00 in deposit. It was agreed, that the balance is to be paid immediately at the end of the company’s event.  Rocky Star Events Sdn. Bhd. paid for the deposit and prepared for the event.  

However, due to the Movement Control Order imposed by the Government of Malaysia which starts on March 2020, Rocky Star Events Sdn. Bhd. has called off the event and requested to return the deposit. Iwan is furious and wants to sue Rocky Star Events Sdn. Bhd. for breach of the agreement and to claim for damages due to loss of income claiming that Iwan has rejected several offers because of the event that was initially agreed.
