However, Albert did not tell Fred that the use proposed by the intending lessee required council approval, which had not yet been obtained. The property was purchased by Fred, but council failed to give the approval to the intending lessee.

Jewellery was advertised for sale in Amy's Pty Ltd Christmas Sale Catalogue with a picture of the jewellery item, a printed description of the item, a printed price in black print which had been struck through (strikethrough price) and a different and highlighted price printed in red and in a large print (the sale price). In reality, none of the jewellery items had been sold at the strike-through price. Rather the highest price at which the jewellery items had been sold was significantly less than the ticketed price.
