Albert,a19-year-oldUniversitystudent,andJessica,18-year-old, have been in a relationship for a year and they both reside close to each other in their family homes in Sheffield. One fateful day, Albert's friend, Piers, informed him that he saw Jessica enter the house of one of his mates,Gareth, late at night and he suspects they might be having an affair. Out of anger, Albert picked up a knife and told Piershe was going to Gareth's house to 'deal seriously withtheboth of them'.
On arriving at Gareth's house, it wasdark, and the entrance door was locked, so Albert broke into the house using some items he found in anearby workshop. Upon gaining entrance, he was immediately confronted by a young lady who inquired who he was and, because it was dark, he did not know who it was but assumed it was Jessica and immediately stabbed her twice in the chestand once on the neck. It turned out she was Gareth's sister, Olivia, that had come to visit him.Her screams brought out Gareth and Jessica from one of the rooms and Gareth immediately confronted Albert who stabbed him twice in the chest and grabbed Jessica that was trying to get awaythrough the entrance door. A struggle ensued between Albert and Jessica and he covered her mouthand nosewith his hand to calm her downand keep her quiet, but sheappeared to havesuffocated due to his hand covering her noseand collapsed on the floor.
Fearing they were all dead, Albert immediately grabbed Jessica's body and stuck in the boot of his Ford car that he drove to the house and drove off erratically. While driving away, he was going at 70MPH in a 30MPH zone and struck down threedrunkparty-goers who were just leaving a pub.Two died instantly but the third one, Joseph, only suffered minor bruises and was immediately rushedto the hospital where the doctor on duty erroneously administered the wrong medication to him which caused an adverse reaction and eventually led to his death 48 hours later.
Meanwhile, Albert got to his house and, thinking Jessica was already dead, put herin his big freezer to conceal the smell of her body and to keep her body fresh seeing he loved herwhile alive. Her body was discovered 48hours later when police searched his home. An autopsy conductedconcludedthat Jessica did not die from suffocation,as Albert thought, but died fromhypothermia (excess exposure to cold environment) as a result of being kept in the freezer.
Albert, during police interrogation, indicated he didn't intend to kill Jessica when he kept her in the fridge as he thought she was already dead and would definitely not have put her there if he knew she was alive, as he loved her. When confronted with Olivia's death, he said it was a mistake as he did not know who she was and would not have harmed her as he had no issue with her.Medical records also showed that Albert had been diagnosedwithSchizophrenia which causes him to engage in delusional thinking, apropensity to violence and irrational actions.
Discuss-
a)Albert'scriminalliability in relation to Gareth, Olivia, Jessica,Joseph andtheothertwo pub-goers.
b)Examine Albert's criminal capacity in light of his medical diagnosisand the implication of this diagnosis on his criminal liability.
also it doesn't mention that Gareth and and Olivia died but do I just assume they did and answer it that way. And as for the other two pub goers is it murder as he was speeding and killed them ? But he didn't have the intention to do so. And to do with Uk law.
