Allison Fitting issued a check for $800. After writing the check she had second thoughts and contacted Farmers Mutual Bank about the possibility of stopping payment. A bank employee advised Fitting to withdraw money from her account so there would not be enough money in her account to cover the $800 check. The bank employee indicated that the bank would not pay the check. Fitting withdrew money leaving only enough to cover other checks she had written. Even though there would be and overdraft the bank paid the $800 check. Is Fitting liable for the overdraft or should the bank stop payment on the check.
