An 18 year old girl, one of 10 children whose mother was a welfare recipient, was allegedly told by a county social worker that if she refused to be sterilized, her mother would lose her welfare payments. Although the state had an involuntary sterilization statue for mental incompetents residing instate institution, there was no allegation that the plaintiff was developmentally disabled or incompetent. To the knowledge of the court, there had not been any intelligence tests administered. There was no court order. After her mother's death and upon reaching legal age the plaintiffs filed suit against the social worker who had required sterilization, the county welfare department, the physician who performed the procedure, and the hospital in which the operation was performed. Was the plaintiff unduly influenced, causing her to consent to a sterilization procedure?
