An After-Acquired License Problem Frank Handley was discharged from his position as a test pilot for Coastline Aviation, Inc., when he was absent from work on one occasion without notifying his superior. The companys employment manual, which had no disclaimer, indicated that an employee would receive three warnings, one oral and two in writing, for unexcused absences before being suspended. Only after a fourth unexcused absence could an employee be discharged. Handley filed a wrongful discharge suit against Coastline based on a breach of the implied contract created by the promises in the employment manual. During the discovery process, attorneys for Coastline found out that Handleys pilots license had been suspended several years before he was hired and that Handley had lied about his license on his job application. The court ruled that even though the lack of a license had not been the reason that he was discharged, under the circumstances, because he had falsified his application and was not qualified to fly an airplane, which is clearly the function of a test pilot, he would not be entitled to receive any damages.
