An automobile crash has occurred wherein the driver of one of the vehicles had consumed alcohol in the 60 minutes prior to the crash. The driver who had consumed alcohol contends that the use of the alcohol had 'absolutely no effect' on the driver's ability to have avoided the crash (which is an issue in the litigation). The BAC level for the driver was beneath the level established in the state for drunk driving.
