An unconscionable contract is one that is so unfair and one sided that it would be unreasonable to enforce it. Under the UCC, a court can evaluate a contract and if the court deems it to have been unconscionable at the time it was made, the court can refuse to enforce the contract. Should courts be allowed to refuse to enforce a contract because it finds that the contract is one sided and unfair? Or should individuals be held responsible for their agreements regardless of how unfair or one sided it may be. Why?
