AND b) Later that day, Gisela asks for your advice on another matter. She is in the UK to meet with an expert witness, Dr Rupert Stone, who has been instructed to provide a report in respect of a multi-million-pound building dispute which has been listed for trial in two weeks' time at the High Court. At the meeting Dr Stone informs Gisela that he has not had time to complete the report due to other work commitments which have overrun. He informs her that he will only be able to finish the report in time for the trial if a further payment of $10,000 is made. During the meeting Gisela reluctantly agrees to this extra payment. She knows that her client in the building dispute is keen for this matter to be litigated soon, and, in any event, it is unlikely that the court would grant a postponement. Further, there is very little chance, at this late stage, of finding someone with the same level of expertise as Dr Stone. On return to the office Gisela begins to doubt her decision and asks you to advise on whether the promise she made is binding under English law. 587 words
