Andile and Siyanda are two childhood friends living in Pongola. In 2019 both attempt matric

examinations and were successful in obtaining Bachelors passes. They decide to approach various

tertiary intuitions to further their studies. They telephone a call centre in Umhlanga Rocks. The call

centre assistant guides them to an online registration for a degree at a private institution called

Richfields. Their qualification is offered by only one campus at the institution, which is at 44 Joe Slovo

street in Durban. Andile and Siyanda must rent a house in Musgrave, Durban to attend lectures at the

campus. Their parents agree to pay their school fees and rent.

Andile and Siyanda locate a suitable house and make all renting arrangements online. They then pay

a deposit.

1.Two days before lectures commences, Andile and Siyanda move into their rented house only to find

there is poor water supply and most of the celling is missing. In addition, the stove connection

appears to have been burnt and cannot be used. Jim, the landlord, refuses to assist, saying that the

lease makes Andile and Siyanda responsible for maintenance.

2. Siyanda is upset and returns to Pongola. She allows Andile to sublease, part of the house they

were renting from Jim to a new student called Spa. Shortly thereafter, Spa stops paying the rent

and Andile is unable to trace him. Spa the sub lessee, claims he paid his rent and is up to date with

payment. He refuses to pay Andile.

Advise Andile as to her rights including any right to seize the goods on the premises which belongs

to Spa.
