Andrew Milner owned a pizza restaurant that employed Pete Marcello. One night after Marcello had finished his shift, Milner called him back into the restaurant and accused him of stealing. An argument ensued, and Milner shoved Marcello, causing him to fall and injure his back. Milner did not provide worker's compensation coverage. Because Milner did not provide workers' compensation coverage as required by law, the state prosecuted him criminally.
