Angel appointed Dave, an advocate and solicitor, toact on her behalf in the sale of her property in Bangsar amounting to RM 2 million. After the purchase price was made, Angel 29 went to see Dave to collect the payment due to her but he was not in. She tried calling Dave at his firm as well on his handphone but to no avail. She left messages inquiring about her money but Dave did not return her messages. Finally, a year after the sale was concluded, Angel received a cheque from Dave amounting to RM1.5 million with a letter stating that Dave had taken RM500,000 as payment for 'incidentals' without explaining what the 'incidentals' were. When Angel finally managed to meet Dave, she saw that he had bought a brand new BMW X5. Angel now wants to take action against Dave for using her money for hispersonal usage. Advice Angel as to the disciplinary proceedings that can be brought against Dave as an advocate and solicitor. You are not required to address other aspects of Dave's liability to Angel such as Dave's civil and criminal liability.
