(A) Marie by way of letters posted on the 5" July, informed Sarah that she was selling her 4 bedroom town house for $40M and Charlotte her lot by the seaside in Montego Bay for $10M. Marie informed them both in the letters "let me have your response by notice in writing no later than Friday, July 12 at 4pm if you will buy same". Charlotte received the offer letter from Marie on July 7 and on the 8" April, she posted her letter of acceptance. Sarah immediately on receiving the letter on the 8" July called Marie and informed her that she thought the price for the townhouse was too high and told her she would pay $35M instead. Marie said no and hung up the phone. Two hours later, Marie received another call from Sarah who heard from a friend who lives in that area that the price is more than reasonable for the size of the townhouse. She told Marie that she was willing to give her the $40M. Marie told her that she was no longer interested in selling her the townhouse. Sarah's son Moses is livid and is threatening to sue Marie as he said his mother was purchasing the townhouse for him. Having not heard from Charlotte about the seaside lot, on the 13"July, Marie informed her friend Pablo on Saturday that she is selling the seaside lot. Pablo informed her that he knew a 15-year-old Molly, who is extremely wealthy and wants a seaside lot to buy, despite having been given two other seaside lots as gifts from her grandmother before she died. Marie is uncomfortable with this and is under pressure from Pablo to sell to 15-year-old Molly. Marie received Charlotte's letter on Monday July 19" and is contemplating to whom she should sell the seaside lot. Advise Marie on all issues arising. (B) Explain with the use of cases the common law principles pertaining to exclusion clauses and signing a contract
