In addition to the verbal agreement, Jeffrey provided Laura with a signed letter indicating that he had received the $500 from her and that he promised to pay her back within 60 days. Jeffrey has not paid Laura back. Raj, a friend of Laura and Jeffrey, told Laura that Jeffrey told her that he had no intention of paying Laura back. Hearsay Statements: 1) Jeffrey's verbal agreement to Laura that he will pay her back 2) Jeffrey's signed letter agreeing to pay Laura back 3) The comments that Raj heard from Jeffrey and told her about Consider the following statements if testified to by Laura during her testimony, and answer the following questions for each of the three statements: 1) Is the statement hearsay? #2 Jeremy is working in his yard when he hears a cry for help from his neighbour Carol's house. Jeremy yells out to Carol, who responds asking him to call 911 and advises that she has been kidnapped but does not know her captor. Police arrive, enter the residence and find Carol with her arms and legs bound and is clearly panicked. As the police are removing the restraints, Carol tells the police that she had been kidnapped by Andrew, her roommate, who was intending to kill her as she knew too much about his drug dealing. Police observations of Carol at the time are that she is shaking, frantic, hysterical and upset. On the ambulance ride to the hospital, Carol tells the police that Andrew had been drinking and doing cocaine, was a drug dealer, and that he was worried she would tell the police. Once at the hospital she declined to make any formal statement, and she does not attend the trial. The Crown, in an attempt to still seek a conviction, wants to either: 1) Have the statements uttered by Carol to the police admitted under the Res Gestae traditional exception; or 2) Have the statements uttered by Carol to the police admitted under the Principled Exception You have been asked to prepare a draft of the submissions on behalf of the Crown with respect to both arguments. Keep in mind that these submissions are intended to be filed in Court to the judge, so you are writing to that person.
