Maggie is a successful actor. Last Tuesday night she was returning home after a performance of the playHappy Days.She was still in costume: shabby wig, threadbare jacket, scruffy hat, and dirty complexion. She was also carrying a new rucksack full of scripts for plays that she was considering acting in as well as some items she had picked up earlier from her local DIY store.
As she approached the driveway of her very large house Maggie was stopped by P.C. Marsden, a plain-clothed police officer. "Whatare you doing in this part of town, oldlady?" asked P.C. Marsden.
Maggie explained that this was her house. "Really?" said P.C. Marsden "And I bet your second home is in the Bahamas." P.C. Marsden then grabbed Maggie's rucksack andrummaged through it.
P.C. Marsden then ordered Maggie to take off her jacket, hat and shoes in order to besearched. He then felt inside Maggie's pockets, socks, around her collar and ran hisfingers through her hair.
On completion of this search, which yielded the latest iPhone, a toothbrush, a pair of latex gloves, a screwdriver and a hacksaw blade as well as a number of scripts P.C.Marsden said to Maggie: "You're nicked. You can't complain. At least you'll get a bed and meal at the station tonight." At this point Maggiepanicked and pushed P.C. Marsdento the ground exclaiming: "I will complain by calling my solicitor. I have no idea who you are. I am a famous thespian for goodness sake!" P.C. Marsden then tripped upMaggie and she fell to the ground.
Hearing thecommotion Maggie's partner, Nelson, came out of the house and thinkingMaggie was being attacked he attempted to hit P.C. Marsden with an umbrella he grabbed from the hallway. P.C. Marsden avoided the blow and wrestled Nelson to the ground and told him hewas "also nicked for affray."
At the police station Maggie was charged with obstructing a police officer in the execution of his duty under section 89 of the Police Act 1996. Nelson was charged with affray under section 3 of the Public Order Act 1986.
