You are an attorney. Congratulations. Your client owns a bakery in a small college town in upstate New York. The bakery has a contract with the local college to supply bread and other baked goods. One day. a student from the college walked into the bakery. He tried to buy a bottle of wine with a fake ID. Your client refused to sell the wine to the student. The student then attempted to sneak the bottle of wine out of the store without paying for it The owner of the bakery. your client. called the police, then followed the student out of the store. The student began to run, and the owner of the bakery forcefully grabbed him, retrieved the bottle of wine, and returned to the bakery with the student and the bottle ofwine. The police arrived and arrested the student for shoplifting. The student admitted that he took the bottle of wine without paying for it. Word of the incident got back to the college. A protest was organized by students who accused your client of proling. racism and false arrest. The protest took place in a park across the street from the bakery. A school administrator provided reimbursement from the college for the expenses incurred by the students for the protest signs The administrator also provided college funds to reimburse the students for pizza that was purchased for the protestors. The college sent your client a letter indicating that it would no longer pay for any of the bakery products. The college, in effect, cancelled the previously negotiated and signed contract with the bakery. A college student wrote an article in the school newspaper. The article gave a very one-sided account of the incident. It portrayed your client as a bully and a racist who was guilty of proling and false arrest. Afaculty advisor for the student newspaper read and approved the article for publication. Following the student protest, the publication of the article and cancellation of the contract, your client's business from walk-in customers decreased by 40%.
