Anthony is employed by Big Red Car Pty Ltd as a salesperson. Big Red Car Pty Ltd trades as Big Red Car Parts (BRCP) and sells automotive parts and accessories. Anthony has been employed by BRCP since 2010.
Anthony lives within walking distance from work in a house he has a mortgage on, with his wife and two young children. Peter loves cars and considers he is working in his dream job. Anthony is very knowledgeable, and well-respected by customers and colleagues. He is loyal to BRCP and always speaks highly of BRCP on social media and in conversation.
One day, Anthony was working in the store when he noticed a man with a large jacket acting suspiciously. Peter observed the man from a distance and saw him place several products into his jacket. He told his manager, and then approached the man and said: "Excuse me sir, can I help you". The man responded: "get fucked". Anthony left the man and went back to the counter, where he and the Manager watched the man put more products in his jacket. The Manager called the Police and as he put down the phone, the man came to the counter to pay for a small item worth $1. "What about the rest of it?", said Anthony. Suddenly, the man ran. Anthony turned and chased, grabbing the man by the shirt as he ran through the door. Another customer also saw what happened and turned to chase. Anthony tackled the man and Anthony and the other customer held the man down. A couple of minutes later, the Police arrived and separated the men. The man who had run had blood pouring from his face and was later found to have a broken nose. The police took statements and then left. By this stage, the man was in an ambulance. A bystander recorded the incident using their mobile phone, and by dinner time, the video was being played on the nightly news and it was reported the man who had run was a war veteran who had PTSD. Social media feedback was mixed - some labelled Anthony a hero, others called him a thug.
The next day, Anthony received a call from HR asking him to attend a meeting at the store. HR business partner Amelia said to Anthony: "I know you thought you were doing the right thing, but you assaulted him".Anthony said: "I didn't punch him, that other customer did, I just held him down so he wouldn't hit me again". Amelia left the room, made a phone call, and came back and said: "I am sorry Anthony, we're terminating you for serious misconduct, effective immediately". Anthony, stunned, started to cry. He left without saying anything further, and later made an unfair dismissal application.
Is Anthony's dismissal harsh, unjust or unreasonable
