Case Problem 4: Patrick and three of his sisters were coowners of four parcels of land. They sold 115 of undivided share to Stephen. The latter then sold the same US share to Nilda without the knowledge and consent of his four co- owners. Nilda then demanded from Patrick, her share in the rentals collected from the tenants of the building in the coowned property yia court action; Patrick demanded his right to redeem from Nilda which the latter refused. Patrick led a complaint for legal redemption with the Coun. in her defense, Nilda said that the 30-day period granted to Patrick had already expired as she sent Patrick a notice of sale on June 13, 2016; enclosed on said letter was a copy of the Deed of Sale. Patrick claimed otherwise. saying said that period did not start to run until her receipt of the summons on August 5. 2016. Question: Whether or not the letter sent by Nilda to Patrick is sufcient as compliance with the notice requirement of Art. 1623 for the purpose of legal redemption? Explain your answer (10 points)
