"Anyone with an ounce of common sense knows that!Of course Asians are better at math, Kenyans are better runners, Russians are better at drinking vodka, Mexicans are better at construction and restaurants, Indians are better at computers, and white people are better at eating chips and watching Tiger King.We will therefore seek out workers to fit our needs and hire those designers who are most familiar with our products."- Elon Musk, Founder and CEO of BEDLA, April 2, 2020.

In an NBC News exclusive interview, Elon Musk commented on his new hiring policy for the next generation of workers at his expanded BEDLA factory in California.Musk announced that the factory would be expanded by an additional 50,000 square feet and they would hire an additional 300 workers to accommodate the production of his newest invention - the electric auto-adjusting mattress and bed.The bed would be able to automatically sense your genetic make-up and adjust to your particular needs. For example, knowing that Asians prefer to sleep on hard surfaces like thin grass mats on boards, the beds would become firm when it sensed someone from the Pacific Rim.As a German approached the bed, it would transform into a harsh and uncomfortable exterior yet keep a sleek, black, and highly efficient look. For the Russian clientele, the bed shouts "Vzdrognem!" and dispenses a bad shot of vodka before you turn in.When an American would approach the bed, it becomes soft and inviting with an angle to the back so they could sit up, watch TV, and each potato chips in bed. When a Caribbean native approached the bed, it reverted to "420 Friendly Mode," changing its shape to become more hammock -like and fire retardant in case the client passed out in bed from "smoking."

Musk decided he would do the interviewing and hiring personally.Having been successful at hiring a Mexican construction firm for the construction of the facility, Musk began hiring the remainder of his workers. He needed people in the following capacities:

Designers/Testers

Assembly Workers

Demonstration Models

Sales People

First, Musk decided to outsource the hiring of the demonstration models. He asked his friend and owner of Discriminating Talent, Inc. Henry Wienerstien to supply the models he would need.Musk told Henry that he wanted 15 models as examples of the various cultures to whom BEDLA would be marketing its new products.Musk would pay Henry $250,000 for the job of supplying these models. He needed the models for a 6 month launch period beginning April 2020.In his hiring of the models, Henry made sure that he hired only healthy and fit models with no piercings, no tattoos, no dreadlocks, and only female.

Musk then began interviewing workers himself for the remaining positions in the company.Starting with the assembly workers, Must knew that the best assembly workers for the electronic pieces would be those of Chinese heritage, particularly those from Taiwan as they had historically been shown to be the best at assembling complex electronic circuitry.Musk designed an ad in Mandarin in the "China Daily", a newspaper specifically for the population of San Francisco's China Town.Musk was down to his final position and was faced with a choice among three candidates - 1) Sally Lu, a first generation American born of Chinese parents.Sally had never worked in a factory, but her parents had worked in a Nike plant until their immigration to the U.S. 12 years prior.2) Ling Lai, a Thai native married to an American businessman.Ling was familiar with assembly work, but had never actually performed it.Ling was a compulsive YouTube watcher who enjoyed watching "how do they do that" videos of assembly plants around the world.3) Betty White, a Caucasian woman born in Boston.Betty was an elementary school teacher by training, but also taught at the local community college in San Francisco. She taught manufacturing and assembly classes to the vocational/technical students - but found the pay was substantially less as a teacher than the assembly work at BEDLA.As part of her teaching, she worked side by side helping the students do the assembly work. After inspecting each person individually, Musk decided Ling was his best choice. He fully supported the idea of online education and she was somewhat Asian - a quality he knew would make a good assembly worker.

Moving on to the Designers and Testers, Musk took a similar approach to hiring as he had in the assembly workers group.Since the beds were designed to sense a persons' nationality and body type through a skin color and a body type scanner, he made sure to get a wide variety of testers. He placed ads in "Junk Food Magazine," "O," and, "Soap Opera Digest" in hopes of getting his American testers. He placed ads in "AARP Magazine" and "Nursing Home Quarterly" to get the aging population. He selected "Gangsta" and "Up In Smoke" to recruit Black and Caribbean testers.Musk personally interviewed each candidate from each group and made the following choices:

1.He selected Graham Popster for his elderly candidate.Musk was faced with the choice of Graham, a white 70 year old grandfather of 4 who had retired from the military, or Buck Hunter, a white 37 year old who looked 70 because he had that "Benjamin Buttons" disorder and he was genetically and physically identical to a 70 year old and had experience in the mattress industry.Musk selected Graham solely because he believed he was more authentic and was actually 70, even though the beds sensed (reacted to) both Buck and Graham as 70 year old males.

2.He selected Lilly White for his American candidate.Lilly was one of 3 candidates interviewed for the position. She was a Causation, Iowa born, and Evangelical Christian. The two other candidates included Sam Wisecracker, a Mississippi born atheist fitness expert with a Ph.D. in Sleep Disorders, and Elbert Swichandler, a preoperative transsexual Muslim woman born from Jackson, Mississippi.Musk found that the beds correctly identified each person as an American, but found that it would not adjust the angle of the back part of the bed for Elbert as it didn't see him as someone who would eat in bed due to his fitness level. Finally, Musk decided the final two candidates were so similar he needed to break the tie.Feeling sure that fewer people would buy a bed tested by a Muslim than an Evangelical Christian, he hired Lilly.

Finally, Musk hired his sales team. These people were responsible for traveling the country and selling his product wholesale to distributors.Part of the job is "coordinating the demonstration of the products for sale to the retail distributors."The stated job qualifications were that you must be able to travel four months per year on average, be able to get in and out of bed with ease, have a good personality conducive to sales, and be organized.Musk was down to his final two choices for the southeast region, Pregg McMom and Soshi DeFunct. Both seemed immensely qualified. They both had experience in mattress sales and demonstrations. However, he had issues with both.Pregg was pregnant with her 11thchild and was planning a 12th.She could no longer get in and out of the bed due to her pregnancy size and slept in a chair. That issue would likely be corrected in two months after the birth of her child - till it happens again.Soshi was socially outstanding, when she was on her medications. She freely admitted that she suffered from bouts of anger management that were controlled when allowed to take her meds on a regular basis. However, her meds must be taken on days where she was not driving. She needed to take her meds every three days.Elon saw problems in both and was not sure he could hire either with these issues, but needed to.Ultimately, he decided that at least pregnancy was temporary and she was on no drugs to keep her sane, so he hired Pregg for the position.

(1.) Musk and BEDLA are now facing several problems.First, he is getting crucified in social media and the news outlets for his choice to make beds that "discriminate."His hiring practices have become well known and he is faced with the choice of terminating this new venture or continuing with the highly profitable line of products. Please advise Musk how to proceed from an ETHICAL standpoint.

(2.) Secondly, Musk and BEDLA are likely to face employment law problems. Please discuss the potential claims Musk and BEDLA will likely face.Discuss the types of claims each may have, the necessary proof each much present and the likely outcome of each case.Be thorough in your analysis.Choose your language carefully as writing and use of legal terms counts.
