Personally, I have trouble with the way certain of our terms are used. With disparate impact discrimination, it may be unfair at times to label an employer as a "discriminator," when they had no intent. I'm actually writing a paper about the impact of the phrasing.

When it comes to sexual harassment, I feel we also may throw that term around a bit too much as well. High profile figures, including Brett Favre, Bill Clinton (Paula Jones incident), and former Republican presidential candidate Herman Cain have been connected with the term sexual harassment, but I'm not sure their actions meet the legal definition we study for liability as sexual harassment (not to say there isn't another ground for liability). Even a 6 year old was once labeled a sexual harasser (link).(Links to an external site.) Some possible questions to consider in your post: Does the failure to meet the legal standard we discussed matter? Should the standard be lessened then to encompass these actions? Should we label less pervasive or physical actions differently? What are your thoughts on these issues and/or even sexual harassment in general?
