APPLICATION OF THE LAW TO FACT 2 - 3 points

FACT 2- After leaving the apartment, Marilyn grabs her large baseball bat and brings it to her baseball practice. She puts it in her trunk and negligently fails to properly close it. While driving, the back of her car opens up and the baseball falls out in the street.
