Arnold is reaching his retirement and is thinking about what he will do with his property, 123 ABC Street, on his death. He has lived there since 1960 and the property has never been registered. He is aware in 2020 that the property has a market value of 400,000 but also feels that selling the property would be too much trouble before his death. He has no children to inherit his property and decides he wishes to be generous. He writes a will in which he states that his kindly neighbour, Berenice, is to inherit his house. He asks the lawyer to undertake the necessary formalities "when the time comes".

Arnold has been in receipt of daily meals provided by a company called Wheels Delivering Meals. He has started a friendship with one of the employees, Candice. Candice talks with Arnold about all aspects of his life, and she learns about his plan to leave the property to Berenice. Candice has hated Berenice ever since Arnold said Berenice's cake was better than that delivered by Wheels Delivering Meals, and so Candice hatches a plan.

Candice waits for Arnold to go into a hospice and then registers herself as the proprietor of 123 ABC Street. She then auctions the property and sells it for 200,000. The new purchaser, Daevisha, is very pleased with her purchase and begins to make adaptations to the property. In order to make her extensive changes, she obtains a mortgage for 75,000 which is secured by a charge over 123 ABC Street.

Arnold passes away and Berenice hears through Arnold's lawyers that she is supposed to receive his house. She is surprised to hear this since she had presumed that Daevisha had purchased the property from him.

Advise Berenice as to whether she has any claims in relation to the property.
