Arthur has a motorbike for sale for $250,000.00. He calls both Garth and Mike on October 20 and tells them that if they are interested in purchasing the bike at the price stated, they are to call him no later than 3 pm on October 24. Garth at the end of the conversation tells Arthur that he needs sometime to think about it and will get back to him. Mike tells Arthur also that he will consider it and get back to him. On the 23rd October, Garth emailed Arthur informing him that he will purchase the bike and will take the cheque on the 24th October at which time he will also collect the bike. Arthur's email is not working so he does not get the message. Mike, having considered the situation, decided to purchase the bike, goes to the bank to get the cheque for the $250,000.00 and arrives at Arthur's home on the 24th October at 3:30 pm, just in time to see Patrick driving off on the bike. Mike threatens to sue Arthur as he is stating that they have a contract. Whilst trying to calm Mike, Garth arrives with the cheque and a copy of the email. When informed by Arthur that the bike was already sold, Garth was livid and threatens to sue Arthur for breach of contract. Molly, aged 14 years, went into 'Computer Biz', a store owned by Arthur and bought a Laptop to assist her with her online classes. The store clerk told Molly that the cost for the Laptop was $100,000.00. Molly is in dire need of the laptop so she paid the clerk $90,000.00 took the Laptop and agreed to pay the additional $10,000.00 within two weeks. It is now more than two months and Molly has not paid 'Computer Biz' the outstanding amount. Arthur promised to give his wife Mary, the $90,000.00 paid by Molly but has not done so. Mary is threatening to sue him. Arthur then decides to check himself into the Sunny Spa & Hotel as he was feeling very stressed. Arriving very late at the hotel he signs the contract for the room at the front desk without reading it. There was also a very large notice at the front door of the hotel which states that the hotel is not liable for any vehicles left overnight on the property and any loss or damage to same. Arthur was very tired when he arrived and failed to observe the sign. This was also a clause in the contract. The next morning, he discovers that his car is stolen from the parking lot and he wishes to sue the hotel for breach of contract. Advise Arthur as follows. 1. Identify all issues arising 2.
