As part of the challenge, the fossil fuel lobby and ICE vehicle manufacturers launch a television and radio advertising blitz in which they attempt to shame the government for its 'lies' and 'short-sighted' policy, while 'impoverishing Australians'. The Minister for the Environment responds by amending the Act in the following way:

Section 115 - National Climate Council a) The Minister may convene a National Climate Council.

c) The objective of the National Climate Council is to direct national climate policy in a strictly neutral and apolitical manner and to inform the public with factual details.

Section 120 - Harmful climate advertising 'Harmful climate advertising' includes any paid media content deemed by the National Climate Council to pose a risk to national climate safety by: a) denying the effects of human-induced climate change; or b) promoting the use of fossil fuels. In determining whether paid media content poses a risk to national climate safety by denying the effects of human-induced climate change, the National Climate Council may only take into account well established matters of scientific fact and emergency services procedure.

Section 121- Restrictions on harmful climate advertising No television, radio or other broadcasting service shall be permitted to display harmful climate advertising. After the amendment, there is a media blackout on advertising by all fossil fuel companies and ICE vehicle manufacturers.

In response to the Safe and Clean Environment Act (Cth) s49, the State of Western Australia amends its existing vehicle registration legislation. Western Australia enacts the Motor Vehicle Registration (Amendment) Act 2023, which contradicts the Commonwealth legislation. It relevantly provides that: ... Section 5 - Registration of four-wheel drive vehicles Notwithstanding any legislative provision to the contrary, the registration of four-wheel drive vehicles of any motor type (including ICE vehicles) will continue in perpetuity. ... QUESTION Advise the Solicitor-General on the constitutional validity of these federal and state government legislative amendments. You need not consider the Cigamatic doctrine.
