As your HR Director, I was to address the concerns and situation about Sam. Our company has to follow a detailed progressive discipline approach in order to ensure employees are following the company's mission and policies. The following are steps that need to happen to resolve the issue: The first step would be an oral reprimand addressing the concerns as an initial warning. The second step would be to counsel the employee to document on paper each time this happens. If the issue is unresolved and there isn't any progress then you may need to transfer, fire, demote, or even suspend the employee. Each disciplinary action must be documented to where the employee can leave a statement and sign acknowledging. Sometimes disciplinary actions are essential because it holds the employee or employer accountable for their actions. Under Maryland State law, all disciplinary actions must be imposed within 30 calendar days once aware of misconduct. On the other hand, suspensions must be imposed within 5 business days. According to the Fair Labor Standards Act, all employers must keep a record of employees times and pay records in the event someone feels discriminated against.
