He has been running his business "Viggo's Visions' for 10 years in the Gold Coast Hinterland. He is so successful that he is often booked out a vyear in advance as he can only make two cakes per week to his exacting standards. Part A Along comes Molly. She sees an opportunity and offers to invest in Viggo's business. Viggo is understandably cautious and suggests they try this for the spring wedding season (September- October). Molly runs her own catering business in the Currumbin Valley and she agrees to this. They agree Molly will invest $4000 to Viggo's Visions which will enable Viggo to hire an apprentice pastry chef and double his output of cakes. Molly will receive 10% of profits on sales of cakes during that period. In November, Viggo pays Molly $3400 being 10% of profits for the two month period. Molly is mortified. She has gone down $600 on her investment. Viggo explains that perhaps the local market is saturated, and he needs to expand wider into the South East Queensland market. Molly remains miffed and seeks to have an equal account of the profits arguing she is a partner under law. Advise Viggo on the nature of his relationship with Molly referring to appropriate authorities. (10marks) This answer should be around 350 words. Assessment 2 BAA2151.pdf Part B Viggo has recovered from his dealings with Molly. The following year he has expanded into the South East Queensland market. He meets Veruka at a wedding expo in Brisbane and gets on really well with her. They share the same ethos regarding the use of organic ingredients in cakes and in meeting the desires of brides and grooms, no matter the brief. Viggo and Veruka start making cakes together under the name V2 Cakes with a focus on high end speciality wedding cakes. Prices start from SB00O per cake. They do this successfully for 12 months. They agree to stop running their own wedding cake businesses and focus on V2 Cakes. Veruka books a Wedding Expo in Sydney signing a contract as a stall holder which requires a 30% deposit and 70% on day 1 of the Expo. The total cost is $10,000 as Veruka ordered a double stall to create a wedding chapel theme. Viggo says he does not want to cater to Sydney brides as they are too difficult and states she should have consulted him first. He refuses to pay the invoice and argues she booked it, so she should go alone via her old cake business. Advise Viggo on the legal nature of his business relationship Veruka and what hs rights are with respect to the Sydney Expo. Refer to appropriate authorities (cases and legislation) (10 marks) This answer should be about 350 words Part C Viggo gets over the Sydney Expo with your advice (whatever that may be). The second year Assessment 2 BAA2151.pdf LR (B Part C Viggo gets over the Sydney Expo with your advice (whatever that may be). The second year in business Veruka breaks her hip slipping on some butter cream icing. She is unable to work in the V2 Cakes business for an extended period. Viggo manages to keep the business going but profits decline with one less baker and cake decorator. As medical bills mount up Veruka gets worried. She goes onto the online orders for V2 Cakes and follows up an inquiry. As a result, she books an expensive cake for 6 months in advance and takes a deposit of $6000. Veruka uses the funds to pay her medical bills and her mortgage. One month before the cake is due to be delivered, the bride calls to ask why she has not had the complimentary meeting to discuss the cake. Viggo is horrified. In fact, he suffers from a debilitating attack of vertigo and needs to take several days off work. When he returns the problem is still there and his reliable apprentice, Chez asks what to do. Chez reports he cannot find the order anywhere in the V2 Cakes finance system. Viggo checks the accounts and no deposits are recorded despite the bride producing receipts with the V2 Cakes logo on them. Then Viggo notices that Veruka's poor attempt at his signature is on the receipt. He suffers another vertigo attack, but Chez throws cold water on his face and says: \"we need to focus on this cake.\" Viggo wants to argue that the order was not authorised and that he is not responsible for the signature on the receipt. He is also concerned about his reputation but figures he still = Assessment 2 BAA2151.pdf A 100% + (RS Viggo wants to argue that the order was not authorised and that he is not responsible for the signature on the receipt. He is also concerned about his reputation but figures he still has Viggo's Visions to fall back on. Advise Viggo on the following four issues (20 marks). This answer should be about 800 words. a) Can Viggo assert he is not bound by the order as he did not take it and it is not in the booking system? b) Is V2 Cakes bound to make and deliver the cake to the bride? } Can Viggo take action against Veruka in relation to the deposit received? d) Would your advice be any different if these were the facts: After Veruka broke her hip, Viggo had put a notice on the V2 Cakes website stating that less orders were being taking until Veruka recovered from her fall and could bake again. The bride who ordered the cake has read that notice and called Veruka direct saying \"I know you are not working at V2 Cakes. Chez told me that they could not make a Bluey wedding cake as it did not fit their brand. Could you just make me the cake as a favour?' Veruka agrees as she needs the money but sadly her skills are impacted by her unsteady gait and the sub-standard cake collapsed mid wedding reception. The bride sues V2 Cakes for ruining her wedding. Notwithstanding what the brides cause of action might be, where does liability fall? Viggo, V2 Cakes, Veruka and why
